VidArt AI Terms of Use

1. Acceptance of Terms

These Terms of Use (“Terms”) are a legally binding agreement between you (“you”) and AI Video Platform (“we,” “us,” or “our”) for your use of the VidArt AI app for iOS (the “App”).

By downloading, installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

The App is rated 18+ on the App Store. By using it, you confirm that you are at least 18 years old.

2. Your Account

• When you first open the App, an anonymous account is created for you. You do not need to give us any personal information.
• Your account is tied to your device and cannot be transferred.
• If you lose access to your device or reset it, your account, history and remaining credits may be lost. Restore Purchases can bring back an account that made a purchase, on the same Apple Account.
• We are not responsible for lost credits, content or account access caused by device changes or data loss.

3. The App

VidArt AI lets you create AI videos and images from text prompts and from photos, videos and audio you provide, apply styles and effects, and plan creations with a chat assistant.

3.1 Third Party AI Providers

Generations are produced by our AI generation provider, Vidom, and chat replies by Microsoft’s Azure OpenAI service. We do not control and are not responsible for the outputs of these AI models, including their accuracy, quality, appropriateness or legality.

3.2 Availability

We may change, suspend or stop any part of the App at any time, including specific features, styles, models or providers. The availability, quality and speed of generation may vary for reasons outside our control.

4. Credits and Purchases

4.1 Free to Download

The App is free to download. New accounts receive free starting credits, and more free credits may be offered from time to time, for example as a daily gift. Optional paid products are described in Section 4.3.

4.2 Credits

• Credits are needed to generate videos and images. The number of credits depends on the feature, length, quality and other settings, and is shown before you create.
• Credits have no monetary value outside the App and cannot be sold, transferred or exchanged for cash.
• Credits cannot be moved between accounts or devices.
• We may change credit costs, free allowances and the credits included in paid products at any time.
• If a generation fails, the credits it used are returned to your balance automatically.

4.3 Subscriptions and Credit Packs

The App offers auto renewing subscriptions that grant credits, and one time credit packs. Prices are shown in the App Store in your local currency before you confirm.

Billing. Payment is charged to your Apple Account when you confirm the purchase. Apple processes all payments, and we never receive your payment details.

Auto renewal. Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the current period ends. Your Apple Account is charged for renewal within 24 hours before the period ends. You can turn off auto renewal at any time in iOS Settings under your Apple Account, Subscriptions. Cancellation takes effect at the end of the current period, and you keep access until then. Deleting the App or your account does not cancel a subscription.

Free trial. Where offered, a free trial converts to a paid subscription at the price shown unless you cancel at least 24 hours before the trial ends.

Credit packs. Credit packs are one time purchases. Their credits are added to your balance and follow Section 4.2.

Refunds. Apple handles refund requests under App Store rules at reportaproblem.apple.com. Except where the law requires otherwise, purchases are not refundable by us, and credits already spent are not restored.

Price changes. If a subscription price changes, Apple will notify you under App Store rules and, where required, ask for your consent. If you do not agree, your subscription ends at the close of the current period.

5. Your Content and Rights

5.1 Your Content

You keep ownership of the prompts, photos, videos and audio you submit (“Inputs”). Subject to these Terms and the terms of our providers, you may use the videos and images created from your Inputs (“Outputs”) for personal and commercial purposes. You understand that:

• Other users may receive similar Outputs from similar Inputs, so your rights to Outputs are not exclusive.
• We do not guarantee that Outputs are unique, original or free of third party rights.
• You are responsible for making sure your use of Outputs is lawful and does not infringe anyone’s rights.

You confirm that you have all rights needed to the Inputs you submit, including permission from every person who appears in them.

5.2 License to Us

You give us a worldwide, non exclusive, royalty free license to use, store, reproduce and transmit your Inputs and Outputs only to run the App for you (including sending them to our AI providers), to keep your history, to review reported content and to comply with the law. We do not use your Inputs or Outputs to train our own AI models.

5.3 Our Property

The App, including its software, design, graphics, styles, names and logos, belongs to us or our licensors. These Terms give you only the limited right to use the App as allowed here.

6. Prohibited Uses

You agree not to use the App to:

• Create anything illegal
• Create child sexual abuse material or any content that sexualizes or endangers minors
• Create realistic videos or images of a real, identifiable person without that person’s permission
• Create hateful, sexual, violent, harassing or abusive content
• Infringe anyone’s copyright, trademark or other rights
• Create misinformation intended to deceive, or impersonate any person or organization
• Reverse engineer the App or the AI models behind it
• Abuse the credit system, including through bugs, multiple accounts or automation
• Use bots or scripts to access the App, or overload our systems
• Resell access to the App

We may remove content, suspend or terminate accounts, and report illegal content to the authorities.

7. Reporting and Moderation

You can report any video in the App. We review reports and remove content and accounts that break these Terms. Our AI providers may also refuse some requests.

8. AI Generated Content

Outputs are produced by AI models and may be inaccurate, unexpected or objectionable. You are responsible for reviewing every Output before you use or share it.

9. Disclaimers

The App is provided “as is” and “as available,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, title and non infringement. We do not warrant that the App will be uninterrupted, secure or error free, that Outputs will meet your expectations or be free of third party rights, or that any AI provider will remain available.

10. Limitation of Liability

To the maximum extent permitted by law, AI Video Platform and its officers, employees and suppliers are not liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, content, credits or reputation, or damages caused by AI providers. Our total liability for all claims relating to the App will not exceed the greater of the amount you paid through the App in the twelve months before the claim or one hundred U.S. dollars (US $100).

Some jurisdictions do not allow these limitations, so they may not apply to you in full.

11. Indemnification

You agree to defend, indemnify and hold harmless AI Video Platform from claims, losses and expenses (including reasonable legal fees) arising from your use of the App, your Inputs and Outputs, your breach of these Terms or your violation of anyone’s rights.

12. Dispute Resolution

12.1 Informal Resolution

Before starting any formal proceeding, please contact us at admin@aivideoplatform.ai. We will try to resolve the dispute within 60 days.

12.2 Binding Arbitration

Disputes not resolved informally will be settled by final, binding individual arbitration under the rules of the American Arbitration Association, in English, in the State of California, United States.

12.3 Class Action Waiver

You and AI Video Platform may bring claims against each other only individually, and not as a plaintiff or class member in any class, consolidated or representative proceeding.

12.4 Opt Out

You may opt out of arbitration by emailing admin@aivideoplatform.ai within 30 days of first using the App, with your user ID and a clear statement that you opt out.

12.5 Exceptions

Either party may bring claims in small claims court, or seek injunctive relief for intellectual property infringement in any competent court.

13. Apple App Store Terms

• These Terms are between you and AI Video Platform only, not Apple Inc. (“Apple”). Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any. Apple has no other warranty obligation for the App.
• Apple is not responsible for any claims relating to the App, including product liability, legal or regulatory compliance, or intellectual property claims.
• Apple and its subsidiaries are third party beneficiaries of these Terms and may enforce them against you.

14. Termination

We may suspend or end your access to the App at any time, including for breaking these Terms. When access ends, your remaining credits are forfeited and your content may be deleted. You may stop using the App at any time, and you can delete your account in Settings. Sections that by their nature should survive termination will survive.

15. Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law rules. Where arbitration does not apply, you agree to the exclusive jurisdiction of the courts located in California.

16. General

These Terms and our Privacy Policy are the entire agreement between you and us about the App. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms; we may. We are not liable for delays caused by events beyond our reasonable control. We may update these Terms and will notify you in the App of material changes. Continued use after a change means you accept it.
